Breaking News – New Overtime Rule Put on Hold

Yesterday a Federal judge’s injunction put a hold on the implementation of the new U.S. Department of Labor’s updated salary threshold used for the FLSA overtime exemption test  This new threshold  was set to go into effect on December 1, 2016.  

Employers may continue to utilize the current exemption testing threshold while the case is in progress, but the new salary threshold could still be implemented in the future.  We recommend seeking legal counsel regarding any decisions regarding employment agreements/contracts for your organization.
